Overview

Wasatch County School District is committed to fostering a safe, respectful educational environment free from sex-based discrimination, including sexual harassment and assault. The district follows the Title IX process outlined by federal law to ensure fair, timely, and equitable resolution of Title IX complaints.

  1. Report of Sexual Harassment or Misconduct
  • Anyone (student, staff, parent, or third party) can report sexual harassment to the Title IX Coordinator.
  • Reports may be submitted in person, by mail, email, or phone and can be made at any time, including outside school hours.

Note: A report is not the same as a formal complaint. A report starts the process of outreach and support, not an investigation.

  1. Initial Response & Supportive Measures
  • The Title IX Coordinator promptly contacts the complainant to:
    • Discuss the availability of supportive measures (counseling, schedule changes, no-contact orders, etc.)
    • Explain the formal complaint process
  • Supportive measures are available regardless of whether a formal complaint is filed.
  1. Filing a Formal Complaint
  • A formal complaint is a written document filed by the complainant or signed by the Title IX Coordinator requesting an investigation.
  • The respondent (accused individual) is notified and provided with details of the allegations and their rights.
  1. Investigation
  • The district assigns a trained investigator to gather evidence from both parties and witnesses.
  • Each party:
    • May have an advisor of their choice, including a parent, teacher, or attorney.
    • Has an equal opportunity to present evidence, including witnesses and documents.
  • Both parties receive timely updates and have access to the evidence collected.
  1. Review & Response
  • Before a decision is made, both parties:
    • Receive a copy of the evidence report.
    • Have 10 days to review and submit a written response.
  1. Decision-Making Process
  • A trained decision-maker (not the investigator or Title IX Coordinator) reviews all evidence and written responses.
  • The decision-maker issues a written determination based on the preponderance of the evidence (more likely than not).
  • The determination includes:
    • Findings of fact
    • Conclusions
    • Any disciplinary sanctions (if applicable)
    • Information on how to appeal
  1. Appeals
  • Either party may appeal the outcome on specific grounds:
    • Procedural errors
    • New evidence not previously available
    • Conflict of interest or bias
  • Appeals must be submitted in writing within the timeline provided in the determination notice.
  1. Informal Resolution (Optional)
  • At any point after a formal complaint is filed, both parties may voluntarily agree to informal resolution (e.g., mediation), except in cases involving allegations by a student against an employee.
  • Participation must be voluntary, and either party can return to the formal process at any time before resolution.
  1. Recordkeeping & Confidentiality
  • The district maintains records of the Title IX process for at least 7 years.
  • Confidentiality is maintained to the greatest extent possible and is only shared with those who need to know.
